1. Who We Are
This Privacy Policy explains how Benchmark Holdings of PA Inc., doing business as BARE Lawn Care and Blue Mountain LandWorks (“we,” “us,” “our”), collects, uses and protects information through barelawncare.com, bmlandworks.com (the “Sites”) and our related services. By using the Sites, you agree to this policy.
2. Information We Collect
2.1 Information you give us. When you request a quote, schedule a consultation, place an order, create an account, apply for a job or contact us, we may collect:
- your name, phone number, email address and preferred contact method
- your property or delivery address
- details about your yard, project, budget and the services or materials you are interested in
- photos you send us of your property
- payment details, which are entered with and handled by our payment processors
- job application details, such as work history and availability
- messages, reviews and feedback you send us
2.2 Information collected automatically. When you visit the Sites, we and our service providers may collect your IP address, browser and device type, pages viewed, links clicked, the site that referred you, and approximate location based on your IP address. This is collected through cookies and similar technologies (see section 5).
2.3 Information from others. We may receive information about you from customers who refer you, from review platforms, or from a business whose customer accounts we have taken over, when you were a customer of that business.
3. How We Use Your Information
We use your information to:
- respond to quote requests, questions and consultation requests
- prepare estimates, schedule visits and deliveries, and provide our services
- process payments, deposits and recurring plan billing
- send service messages about scheduling, renewals, billing and weather delays
- send promotional offers, only where you have opted in
- review job applications
- improve the Sites, our services and our customer experience
- protect against fraud and comply with legal obligations, such as pesticide application records required by Pennsylvania law
4. How We Share Your Information
4.1 We do not sell your personal information. We do not sell, rent or trade your information to other companies for their own marketing.
4.2 Service providers. We share information with companies that help us run our business, only as needed for them to do that work. These include:
- Jobber, for scheduling, quotes, invoicing and customer accounts
- WP Engine and WordPress, for website hosting
- WPForms, for website forms
- WooCommerce and our payment processors, for online orders and payments
- website analytics providers, to understand how the Sites are used
- email and text messaging providers, for customer communications
4.3 Between our brands. BARE Lawn Care and Blue Mountain LandWorks are operated by the same company and may share customer information with each other to provide the services you request, such as a material delivery for a lawn restoration project.
4.4 Legal and business transfers. We may disclose information if required by law, to protect our rights or safety, or as part of the sale or transfer of all or part of our business.
5. Cookies and Analytics
5.1 What we use. The Sites use cookies and similar technologies to keep them working, remember your form entries and cart, measure traffic, and understand which pages are useful.
5.2 Your choices. You can block or delete cookies in your browser settings, though some features, such as forms, the estimator or checkout, may not work properly. Our Sites do not currently respond to “Do Not Track” browser signals.
6. Text Messages
6.1 Consent. If you give us your mobile number, we may send texts about your quote, service, scheduling and billing. We send marketing texts only if you opt in.
6.2 Your number stays with us. We do not share or sell your mobile number or text messaging consent with third parties or affiliates for their marketing purposes. Information is shared only with the messaging providers that deliver our texts.
6.3 Opting out. Reply STOP to any text to opt out, or HELP for help. Message frequency varies. Message and data rates may apply.
7. Your Choices
You can ask us to:
- tell you what personal information we hold about you
- correct information that is wrong or out of date
- delete your information, unless we need to keep it for an active service, billing, or legal or tax records
- stop sending you marketing emails or texts
To make a request, email us at the address in section 11. We may need to confirm your identity before acting on a request. Depending on where you live, you may have additional rights under your state’s privacy laws, and we will honor them as required.
8. How We Protect Your Information
We use reasonable safeguards to protect your information, including secure hosting, encrypted (HTTPS) connections on the Sites, and limiting access to people who need it for their work. Payment card details are handled by our payment processors and are not stored on our servers. No website or storage system is completely secure, so we cannot guarantee absolute security.
9. How Long We Keep Information
We keep your information for as long as you are a customer or need it for the purpose it was collected, then as long as needed for tax, accounting, legal and pesticide recordkeeping requirements. Quote requests that do not become jobs are kept for up to 2 years so we can follow up, unless you ask us to delete them.
10. Children’s Privacy
The Sites are intended for adults and are not directed to children under 13. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, contact us and we will delete it. Job applicants under 18 may apply with a parent’s or guardian’s involvement.
11. Changes and Contact
11.1 Changes to this policy. We may update this Privacy Policy from time to time. We will post the new version on this page with a new effective date. If we make a significant change to how we use your information, we will give notice on the Sites or by email.
